The Site provides an interactive online service operated by Coupawz LLC, consisting of information services, content and transaction capabilities facilitated through Coupawz LLC, affiliates of Coupawz LLC or merchants (“Merchants”) offering vouchers for sale (“Vouchers”) which may be exchanged for goods/services at Merchants and other third parties.

This Agreement sets forth the terms and conditions that apply to the use of this Site by the End User. By using this Site (other than to read this Agreement for the first time), End User agrees to comply with all of the terms and conditions hereof. The right to use this Site is personal to End User and is not transferable to any other person or entity. End User shall be responsible for protecting the confidentiality of End User’s password(s), if any. End User acknowledges that, although the Internet is often a secure environment, sometimes there are interruptions in service or events that are beyond the control of Coupawz LLC, and Coupawz LLC shall not be responsible for any data lost while transmitting information on the Internet.

While it is Coupawz LLC’s objective is to make the Site accessible 24 hours per day, 7 days per week, the Site may be unavailable from time to time for any reason including, without limitation, routine maintenance. You understand and acknowledge that due to circumstances both within and outside of the control of Coupawz LLC, access to the Site may be interrupted, suspended or terminated from time to time.

Coupawz LLC shall have the right at any time to change or discontinue any aspect or feature of the Site, including, but not limited to, content, hours of availability and equipment needed for access or use. Further, Coupawz LLC may discontinue disseminating any portion of information or category of information, may change or eliminate any transmission method and may change transmission speeds or other signal characteristics. You represent that you are of legal age to form a binding contract. You must be at least 18 years old to be eligible to use the Site. However, if you are at least 13 years old but not yet 18, you may use the Site in conjunction with your parent or guardian who agrees to this Agreement. No one under age 13 may use the Site.
LICENSES AND RESTRICTIONS This site is owned and operated by Coupawz LLC. You may view material from this site only for your personal, noncommercial use. You agree not to: post material from this site on another web site; scrape or extract data, business names, deals, or other pertinent information from this site; transmit or redistribute material from this site; or link to this site within a framed webpage.

If you choose to register as a user or make a purchase from this site, you agree to comply with all applicable laws and to provide only truthful and accurate information as requested.

PURCHASES AND REFUNDS Coupawz LLC acts as a broker. When you purchase a voucher from Coupawz LLC, you receive at a discounted price a voucher that shows the value of goods or services that you can obtain from the merchant whose voucher you have purchased. Coupawz LLC retains a commission from the money you pay to purchase the voucher, but remits the majority of your purchase price to the merchant. In this way, you are obtaining a discount by pre-paying the vendor for goods and services through the Coupawz LLC website. Coupawz LLC is earning a fee for providing this service to you.

When you make a purchase from Coupawz LLC, you are agreeing to the terms of the deal as presented at the time of purchase. In every case, this includes not duplicating vouchers or attempting to alter, deface, or misrepresent any details or terms related to a voucher or offer. You understand that vouchers must be used on or before the expiration date shown on the voucher.

You understand that the vouchers offered on Coupawz LLC may change at any time; that only a limited number of a particular voucher may be made available, either in total or to a single customer; that a particular customer may be restricted as to the number or type of vouchers that the customer is permitted to purchase; and that other restrictions not listed here may apply to specific offers, promotions, or vouchers on the Coupawz LLC site. All sales are final. If you present a voucher with a valid expiration date and the merchant declines to accept please contact us immediately by calling us at 646-420-PAWZ (7299) or sending an email to support@coupawz.com. We will contact the merchant directly and resolve the issue or offer you a refund/credit for the amount of the voucher. If in the unfortunate event the business you hold a voucher to is no longer in business Coupawz will refund you the full amount of your voucher.

LIMITATIONS OF LIABILITY

Coupawz LLC is not liable for any special or consequential damages resulting from your use of, or your inability to use, the materials in this site, any linked site, or any voucher purchased via this site. In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing this site or, if a potential claim relates to a specific voucher, the total amount that you paid for that voucher.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE AND IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE FUNCTIONS CONTAINED AT THIS SITE WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

JURISDICTION AND APPLICABLE LAW This agreement shall be governed by the laws of the State of Texas, as applied to agreements entered into and to be performed entirely within the state, without giving effect to any principles of conflicts of law. Any action you bring to enforce this agreement or any matters related to this site shall be brought in either the state or federal courts located in Travis County, Texas, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any provision of this agreement is unlawful, void, or unenforceable in whole or in part, the remaining provisions shall not be affected, unless we determine that the invalid or unenforceable provision is an essential term to the agreement, in which case we may at our sole discretion amend the agreement.
